This is my full copyright statement. Some of this may be duplicated from the previous page.
These machine embroidery designs have been designed and digitised by me, Sue Gardner. Therefore the copyright of these designs belongs to me. Please do NOT under any circumstances pass on or sell on these designs. This includes the designs being in or on a cd/other electronic storage media/email for sale/sharing/lending out in any form to a third party. Only you the purchaser has the right to have these designs in your possession, no-one else and only you have the licence to use them and stitch them out. You cannot claim them to be your own work even if you’ve added elements of your own digitising or altered them in any way. This applies to both the free designs and the designs for sale. Purchased design sets can be tracked back to the original purchaser. Please do not share.
My designs are ONLY available for sale from this website and no other source. The only exception may be approved charity designs which I have donated for free for a particular disaster appeal such as the Cigar City Arts Hurricane relief fund raiser - these designs may also appear for sale on my website. My designs are not available for sale on eBay, although in 2004 designs were available on eBay prior to setting up this website.
You are permitted to make a back up copy of the designs purchased from me for your own personal use only and for no other use. In fact I recommend that you make a back up copy on CD or floppy. If you lose your designs due to a computer crash, I will send a replacement design free of charge once your original purchase has been verified. This will only be done once per design, subsequent requests may incur a small administration fee.
You may sell the finished stitched out design. Enquire if you wish to use this design commercially (i.e. in large quantities) for business purposes. Craft fairs, charity fundraisers etc are fine, you don’t need to ask permission. Please make the appropriate reference to the designer on the tag (website address/logo) if you’re selling the stitched out design. I realise this is not always possible/practical however this is general good business practice and common courtesy of giving credit where credit is due but is by no means compulsory.
I am happy for people to resize, add lettering or change colours but please do not make other significant alterations to my designs unless otherwise stated or implied that you should do so especially if you are going to sell the finished sewn out design. For example it is ok to put someone else’s design on my plain lace bowl grid (providing it is within the terms of their copyright statement) and some items encourage you to be individual and add embellishments, wording etc.
However, due to the nature of my designs, many of them may not be suitable for resizing etc. The resizing of my designs is totally at your risk as if you resize, the design is no longer as it was sold and tested and I can’t guarantee that you will get a good stitch out.
If you are in doubt about what “significant alterations” you can make to any particular design that you intend to sell once stitched out then please email me with your specific query, I’m usually fairly understanding. One-off editing of a design for personal use only is generally acceptable without further reference to me.
Hopefully the above guidelines on what you can and can’t do are common sense giving flexibility to the home embroiderer yet whilst protecting my interests as a digitiser.
